Would you believe that there is one state out of fifty that has the fortitude to exercise their Tenth Amendment rights?
“A bill to amend the Code of Laws of South Carolina, 1976, so as to enact the ‘South Carolina Freedom of Health Care Protection Act’ by adding Article 21 to Chapter 71, Title 38 so as to render null and void certain unconstitutional laws enacted by the Congress of the United States taking control over the health insurance industry and mandating that individuals purchase health insurance under threat of penalty; to prohibit certain individuals from enforcing or attempting to enforce such unconstitutional laws; and to establish criminal penalties and civil liability for violating this article.”
In effect, H3101 prohibits any and all agents, officials or employees of the state of South Carolina from implementing any provision that is part of Obamacare. It also allows for the issuing of a state tax deduction equal to the tax penalty enacted by the IRS and makes the state exchanges illegal. They are also considering two additional provisions that would make the Medicare expansion illegal and the suspension of state insurance licenses of any insurer that received federal subsidies through Obamacare.
The bill passed the South Carolina House in April by a 65-34 vote. The bill has now gone to the Republican controlled Senate with a special-order priority. They are expected to easily pass the bill, sending it to the desk of South Carolina’s Republican Governor Nikki Haley. From everything I’ve heard, Haley will most likely sign the bill into law as soon as possible, making South Carolina to take such drastic action to stop the implementation and enforcement of Obamacare in their state.
State Sen. Tom Davis (R-Beaufort) commented:
“It will essentially have five components to it, all of which in my judgment are legal, effective, and within the state’s power to do.”
Defending the bill, Davis said that it is based upon the anti-commandeering doctrine that was established in case law that stated that the federal government cannot force a state to enforce federal laws. He explained:
“What the Supreme Court said in Printz v. United States is that states are not merely political subdivisions of the federal government to carry out what the federal government does; they are sovereign entities. Congress can pass laws, but it cannot compel the states to utilize either their treasury or personnel to implement those federal laws.”
It’s about time a state does the right thing in standing up to the federal government and exercising their Tenth Amendment rights to state sovereignty. Our Founding Fathers knew the dangers of a growing federal government and purposely wrote the Tenth Amendment to protect the states’ rights to sovereignly govern themselves, free of federal hindrance.
Now if only more states would follow South Carolina’s example and enact their own anti-Obamacare legislation, more Americans would be spared the financial devastation created by the Affordable Care Act. Unfortunately, Kentucky’s Democratic Governor Steve Beshear is so pro-Obama that if the president stopped suddenly we might actually lose sight of Beshear.
A bill set for fast-track passage in the South Carolina Senate in January aims to eliminate Obamacare in the state. The law could become a model for other states fed up with the federal health-care law.
House Bill 3101, titled the “South Carolina Freedom of Health Care Protection Act,” passed the state House of Representatives last April by a 65-34 vote. The bill now heads to the GOP-controlled Senate with special-order priority, setting up the likelihood that South Carolina will become the first state to exempt citizens and businesses from all participation in the Affordable Care Act.
State Sen. Tom Davis, the bill’s sponsor who recently wrapped up study committee hearings for H3101 in Columbia, Charleston and other cities, says that the proposed legislation renders the Affordable Care Act void or inoperable through a handful of provisions.
“It will essentially have five components to it, all of which in my judgment are legal, effective, and within the state’s power to do,” Davis, a Republican from Beaufort, said in an interview.
The bill’s main component prohibits agencies, officers and employees of the state of South Carolina from implementing any provisions of the Affordable Care Act, leaving implementation of the national health-care law entirely in the hands of a federal government that lacks the resources or personnel to carry out the programs it mandates.
This provision, according to Davis, comes from the anti-commandeering doctrine established in case law that says feds can’t compel states to enforce federal laws.
“What the Supreme Court said in Printz v. United States is that states are not merely political subdivisions of the federal government to carry out what the federal government does; they are sovereign entities,” Davis said. “Congress can pass laws, but it cannot compel the states to utilize either their treasury or personnel to implement those federal laws.”
Additional provisions of H3101 further neuter the Affordable Care Act by outlawing state exchanges, issuing tax deductions to individuals equal to the tax penalties levied by the federal government, and directing the state attorney general to sue over whimsical enforcement of the law. Taken together, the provisions effectively repeal the federal law for the people of South Carolina.

Should homosexual men – a group with the highest HIV-infection rates in the nation – be allowed to donate blood? That’s the question the federal government is considering this week as it re-evaluates whether it should lift the 30-year ban on homosexual blood donation. On Thursday, members of the Department of Health and Human Services Advisory Committee on Blood and Tissue Safety and Availability will revisit the issue. But a leading pathologist is warning that the move would heighten the risk of spreading HIV to other Americans. Dr. Jay Brooks, an expert in blood banking and transfusion at the University of Florida’s College of Medicine, told WND the problem with “donations from men who’ve had sex with men is that they have a much higher prevalence of HIV than the heterosexual community.” “They have a much higher prevalence,” he emphasized. The U.S. Centers for Disease Control and Prevention, or CDC, released a 2010 analysis of heavily affected populations showing “men who have sex with men,” or MSM, account for a large majority of new HIV infections, much more so than even injection drug users, or IDUs: In fact, “CDC estimates that MSM represent approximated 4 percent of the male population in the United States, but male-to-male sex accounted for more than three-fourths (78 percent) of new HIV infections among men and nearly two-thirds (63 percent) of all new infections in 2010.”
An estimated 1.1 million Americans are currently infected with HIV, and at least one quarter of those are said to be unaware of their infection. While some people experience symptoms early, others go years without experiencing any signs. The CDC states: “Most people will develop antibodies that standard HIV tests can detect within 2-8 weeks (the average is 25 days). But, there is a chance that some people will take longer to develop antibodies. So, if you had risky sex or engaged in risky behavior with a person who has HIV or whose HIV status is unknown, you may need multiple tests to ensure you were not infected. … In very rare cases, it can take up to six months to develop antibodies to HIV.” More

Vaccine use has skyrocketed in the last 30 years. Speak with virtually any medical doctor and they’re more than happy to provide a long list of reasons they think children should be vaccinated. Current American Academy of Pediatrics recommendations state that children should receive 24 vaccine doses by the age of 15 months and 49 doses by age 6.
Included in those recommendations, the medical establishment even recommends that parents begin vaccinating their children the day they’re born for a disease, Hepatitis B, that is transmitted sexually or thru shared needle use. Who knows why? Because the misinformation surrounding vaccination is so extensive, many parents don’t even question whether or not they should vaccinate their child. However, parents should view these as very major decisions. The lifelong health and well-being of their child may depend on the critical decisions parents make in this area.
A logical look at disease and vaccine statistics may surprise many. Unfortunately, most people are not exposed to all the facts before they’re convinced to inject vaccines. In every mature decision we make in life we need to consider two things: The potential upside gain, if all goes well, verses, the possible down-side risk.
To be as logical and clear as possible, let’s study this important subject in four basic parts:
1- History of vaccines
2- Effectiveness: Have vaccines been proven to work?
3- Safety: What are the likely or potential unwanted side-effects?
4- With or without vaccines, natural ways to safely enhance immunity.
